Christmas Eve Federal Holiday
Dec 22, 2020
President Donald Trump issued an executive order Wednesday that exempts federal employees from work on Monday, December 24, 2018, which is not a regular holiday. For the second year in a row, President Trump has issued an executive order declaring Christmas Eve the official federal holiday of the United States. All executive departments and agencies within the federal government will close on December 23, 2017, the day after Christmas Day, and all duties will be excused on that day, except for special events such as National Remembrance Day.

Federal employees working on Saturday will observe the holiday Saturday, and Friday will be a regular working day. If New Year's Day falls on a Saturday, the day before is not celebrated as a national holiday. Post offices will remain closed on Christmas Eve, December 23, 2017, the day after Christmas Day, but mail will be delivered on that day, according to the US Postal Service.
Private employers are required to observe federal and state holidays, with the main exception being state-chartered banks. State and private companies are not obliged to observe federal holidays, and neither are they obliged to observe state or private holidays. Also closed that day are the U.S. Postal Service, the Federal Reserve Bank of New York and the U.S. Department of Labor.
Even if they close, they are not legally obliged to compensate workers with paid time off. The reason why vacation pay and leisure are not mandatory is that the federal employee wage and hours law, also known as the Fair Labor Standards Act (WSC) or the National Labor Relations Act, does not require compensation for time not spent. If a federal employee has to work regularly during federal holidays, he or she receives paid leave.
If an employee is deemed indispensable and cannot withdraw during the holiday, he or she will receive bonus payments. Private sector employers can offer paid leave, but they are not necessarily obliged to offer this option. They can also decide whether to offer a bonus to workers who work during the federal holidays. However, the possibility of working on public holidays under the Wage and Working Time Act (WSC) of the Federal Government can give companies a competitive advantage.
Unlike other non-federal workers, for whom there is no statutory paid or otherwise paid leave, they have the resources to work in industries that do not pause during the vacation. They also have an incentive to behave in a manner consistent with federal and United States law.
If your company observes a public holiday or other public holiday, it is important to list it in your work manual. You may be keeping a close eye on the date of the holiday in 2021 and the state or municipal holiday you are taking into account to work on the holiday you are planning.
Private companies are not required to pay their employees overtime or vacation benefits when they work on a federal holiday, but they are closed on public holidays. Private employers are often paid to work on holiday, often under union contracts, and private employers can offer paid time off on holidays to their employees. Companies can observe a holiday such as Christmas Eve, New Year's Day or Labor Day and give their employees a bonus of 100 euros for the day without holiday allowance. Public employers, such as public schools, hospitals, colleges, and universities, do not require federal employees to work overtime or take any other form of leave.
The head of an executive department or authority may determine that certain employees must remain open and report for work on Christmas Eve, New Year's Day or any other day of the week, and he or she may continue to determine whether they must do so. The heads of executive departments or agencies may determine that some or all of their departments, agencies, schools, hospitals, colleges and universities, etc. must remain open and report to their employees on the same day as the federal holiday.
Soldiers should always confirm with their local chain of command that they have no federal training for the holiday. Workers should be aware that some workers and others have been asked to work on the federal holiday, including employees of the U.S. Department of Labor, the Federal Bureau of Investigation and other federal agencies. If an employer provides for an additional holiday (including Christmas Eve, New Year's Day or any other day), employees can register for work on that day under the 2017 Paid Leave at Work Act.
